Unprecedented: Spanish Judiciary Sides with Moroccan Culinary Worker
The Supreme Court in the Galicia region (TSXG) has issued a final ruling granting a Moroccan culinary worker the right to temporary residency to work in an Arab-Moroccan restaurant in the city of Pontevedra. This precedent marks a significant victory for migrant workers and safeguards their rights.
According to Spanish media reports, the ruling came after a lengthy legal battle, overturning a previous decision by the initial judicial authorities, which rejected the Moroccan cook’s application before the employer intervened and provided previous rulings contrary to the initial judgment.
The judges of the Supreme Court in Galicia based their decision on Article 65.2 of Royal Decree No. 557/2011, which states that “the national labor situation is considered to allow employment in unqualified positions that are difficult to fill when the employer proves to the immigration office the difficulty of filling the vacancies with workers already integrated into the domestic labor market.”
This ruling is considered a victory for migrants wishing to work in Spain, granting them the right to work provided they have the necessary qualifications. It also reflects the Spanish judiciary’s commitment to the applicable laws in this area.
